TERMS & CONDITIONS – TEACHER TRAINING COURSES
1. DEFINITIONS
1.1
When the following words with capital letters are used in these Terms, this is what they mean:
Booking: your confirmed booking for the Course.
Course: the teacher training course provided by Sussex Yoga Training Ltd, as set out in your Booking.
Payment Schedule: the instalment plan, if applicable, set out in the Booking & payable in accordance with these Terms.
Event Outside Our Control: as defined in clause 8.2.
We / Our / Us: Sussex Yoga Training Ltd.
References to "writing" or "written" include email unless otherwise stated.
2. OUR CONTRACT WITH YOU
2.1
These are the terms & conditions on which We provide the Course.
2.2
Please read these Terms & Conditions carefully before signing them or making any payment towards the Course.
2.3
Submitting a Booking request, signing these Terms & Conditions, or requesting a payment link does not automatically guarantee a place on the Course. Sussex Yoga Training Ltd reserves the right to accept or decline any Booking.
2.4
By signing these Terms & Conditions, you confirm that you have read, understood & accepted them in full.
2.5
These Terms & Conditions form the entire agreement between you & Sussex Yoga Training Ltd in relation to the Course & supersede any previous discussions, correspondence, representations or understandings.
2.6
Your place on the Course is confirmed when Sussex Yoga Training Ltd receives the required deposit, course fee, or other payment due at that stage.
2.7
By signing these Terms & Conditions & making payment, you agree to be bound by them in full.
2.8
Where these Terms & Conditions have been signed before payment is made, the signed Terms & Conditions shall remain binding upon payment being received by Sussex Yoga Training Ltd.
2.9
If payment is not received within any period specified by Sussex Yoga Training Ltd, the place may be offered to another applicant without further notice.
2.10
Sussex Yoga Training Ltd will issue enrolment information, course materials & a welcome pack following confirmation of a student's place on the Course.
2.11
If a student commences attendance on the Course, whether in person, online, or through any course-related activity, such attendance shall constitute further confirmation of acceptance of these Terms & Conditions.
3. CHANGES TO BOOKING OR TERMS
3.1
We may revise these Terms to reflect:
(a) changes in law or regulation; or
(b) updates to our Course delivery.
3.2
You will be given at least one month's written notice of any changes. If you do not agree, you may cancel in line with clause 6.
4. PROVISION OF THE COURSE
4.1
The Course will take place on the dates stated in your Booking.
4.2
We will make every effort to deliver the Course as planned, but delays may occur due to an Event Outside Our Control.
4.3
If We suspend the Course due to organisational issues, We will reschedule. Instalments remain payable.
4.4
If you fail to pay on time under clause 5, We may suspend your right to attend until payment is received in full.
5. PRICE & PAYMENT
5.1
The Course price is set out in your Booking.
5.2
All prices are exclusive of VAT unless otherwise stated.
5.3
A non-refundable deposit of £750 is payable to secure your place on the Course. The Course is offered with limited places & Sussex Yoga Training Ltd commits resources, staffing & administration upon acceptance of a Booking. Accordingly, this deposit is non-refundable in all circumstances except where required by law.
5.4
The balance of the Course fee is payable in accordance with your Payment Schedule.
5.5
Once your place on the Course has been confirmed under clause 2.6, you are liable for the entire Course fee, whether or not you attend all or any part of the Course.
5.6
If you miss any instalment, the full outstanding Course fee becomes immediately due within 7 days.
5.7
All payments, including instalments, must normally be completed at least one day before the Course start date.
By prior written arrangement, instalments may continue after the Course has started.
If any instalment is missed, no refunds are available for change of mind or withdrawal.
No transfer to another Course can be made unless all outstanding fees are settled in full with one single payment, & this payment must be made before attending the replacement Course.
5.8
Late payments may accrue interest at 3% above the Bank of England base rate, calculated daily.
6. CANCELLATIONS & REFUNDS
6.1
Refunds are not available except in the limited circumstances set out below.
6.2
You may cancel within 7 calendar days of Booking confirmation, provided this is not within 60 calendar days of the Course start date. In this case, payments received will be refunded minus the non-refundable £750 deposit & any reasonable costs already incurred.
For the avoidance of doubt, where a student has paid the Course fee in full, whether at the Early Bird rate or the standard Course fee, £750 of that payment shall be treated as the non-refundable deposit & will not be refunded.
6.3
After 7 days from Booking confirmation, or within 60 calendar days of the Course start date, no refunds will be given under any circumstances, as We cannot re-fill your place.
6.4
If you choose not to attend, withdraw part-way, or fail to complete the Course, you remain fully liable for all outstanding payments.
6.5
If We materially breach this contract, go into liquidation, or cancel the Course without offering a reasonable alternative, you are entitled to a refund of payments made, excluding the non-refundable £750 deposit.
6.6
Cancellations must be notified by email to info@sussexyogatraining.uk & take effect on the date received.
7. OUR RIGHTS TO CANCEL OR ALTER
7.1
We may cancel before the Course start due to:
(a) an Event Outside Our Control; or
(b) unavailability of key staff, venues, or materials.
7.2
If We cancel for the reasons above, you will receive a refund of Course fees paid, excluding the non-refundable £750 deposit.
7.3
We may relocate the Course venue within 10 miles of the original location.
7.4
We may cancel with immediate effect if you fail to pay as agreed or otherwise materially breach this contract.
8. EVENTS OUTSIDE OUR CONTROL
8.1
We are not liable for delays or failures caused by Events Outside Our Control.
8.2
Such events include strikes, industrial action, fire, flood, epidemic, pandemic, war, terrorism, government restrictions, severe weather, utility failures, or similar circumstances beyond Our reasonable control.
8.3
If the event continues for more than 30 days, you may cancel, but no refund will be due other than at Our discretion.
9. YOUR COMMITMENT TO LEARNING
9.1
You agree to participate fully in all aspects of the Course.
9.2
Attendance at all Course days is mandatory.
9.3
Attendance at all Course days is expected. Missed days may result in additional tuition, mentoring, administration, assessment & catch-up costs. Accordingly, Sussex Yoga Training Ltd reserves the right to charge up to £150 per missed training day & to delay certification until all required learning has been completed.
This charge is intended to cover the costs associated with missed training & to encourage full attendance on the Course. Sussex Yoga Training Ltd reserves the right to waive or reduce this charge at its sole discretion.
9.4
Certification will only be awarded once all course requirements, attendance requirements, coursework requirements & financial obligations have been fully satisfied.
10. LIABILITY
10.1
We are not responsible for business losses, loss of earnings, travel expenses, accommodation costs, or indirect costs.
10.2
Our total liability is limited to the total amount you have paid for the Course.
10.3
Nothing in these Terms limits liability for death, personal injury, fraud, fraudulent misrepresentation, or any rights under consumer law.
11. OTHER IMPORTANT TERMS
11.1
This contract is personal to you & cannot be transferred without Our prior written consent.
11.2
Each clause operates independently. If one is found unlawful or unenforceable, the remaining clauses remain in force.
11.3
If We fail to enforce any right under this contract, it does not waive Our ability to do so later.
11.4
These Terms are governed by English law. Any dispute shall be subject to the exclusive jurisdiction of the courts of England & Wales.
12. DATA PROTECTION & ACCREDITATION
12.1
By enrolling on the Course, you acknowledge & agree that Sussex Yoga Training Ltd may share your name & email address with Yoga Alliance Professionals (UK) for the purpose of registering you as a trainee on the accredited teacher training programme.
12.2
This information will be shared solely for accreditation, trainee registration, certification, quality assurance & related administrative purposes.
12.3
Yoga Alliance Professionals may contact you directly regarding your trainee registration, accreditation status, membership benefits, certification, or related matters.
12.4
Any ongoing communications from Yoga Alliance Professionals are subject to their own privacy policy & communication preferences. You may opt out of non-essential communications directly with Yoga Alliance Professionals at any time.
12.5
Sussex Yoga Training Ltd will process & share personal information in accordance with applicable UK data protection legislation, including the UK General Data Protection Regulation (UK GDPR) & the Data Protection Act 2018.
